Full offer details →Utah is one of only two US states with zero legal gambling of any kind (Hawaii is the other) — no lottery, no casinos, no sportsbooks, no DFS, no charitable gaming. Unlike Hawaii, Utah's prohibition is enshrined in the state constitution under Article VI, Section 27 (opens in a new tab), which expressly prohibits "any game of chance, lottery, or gift enterprise." Utah courts have interpreted this prohibition broadly, and the Utah Attorney General's office has historically taken aggressive positions against forms of gaming and DFS.
Despite this hostile state framework, CFTC-regulated prediction markets remain legal in Utah via federal Commodity Exchange Act↗ (opens in a new tab) preemption. Federal law preempts conflicting state law under the Supremacy Clause. The Third Circuit↗ (opens in a new tab) sided with Kalshi on sports event contracts at the preliminary-injunction stage (April 6, 2026), but the Ninth and Sixth Circuits have since ruled the other way; Utah is in the Tenth Circuit, which has not ruled.
For UT residents in April 2026 this means Kalshi, Robinhood, Polymarket US, DraftKings Predictions, FanDuel Predicts, Fanatics Markets, OG.com, Novig, Chalkboard and Rebet are all available statewide. The notable exception is Sleeper, which has historically geofenced Utah out of caution given Utah's aggressive enforcement posture against DFS and fantasy products.
Utah AG Derek Brown has not filed enforcement action against any CFTC-regulated prediction-market platform and declined to join AG Campbell's multi-state coalition in November 2025. Sources cite the federal preemption framework as making any state enforcement a near-certain loser.
