The Nebraska Racing and Gaming Commission regulates a small in-person market — Caesars at Harrah's Columbus, WarHorse Lincoln, Grand Island Casino Resort and Quick Bets Omaha all operate retail sportsbooks. Mobile sports betting remains illegal, and a 2024 ballot initiative (LR 20CA) to legalize mobile wagering failed to reach the ballot.
For NE residents this means CFTC-regulated prediction markets are the primary legal way to wager on sports outcomes from a phone. Nebraska AG Mike Hilgers has not moved against CFTC platforms, and the Nebraska Racing and Gaming Commission has issued no prediction-market guidance. Every major CFTC-regulated platform is available statewide, including DraftKings Predictions, FanDuel Predicts and Fanatics Markets (which voluntarily geofence most states with mobile sportsbook competition).
Why Nebraska Is Quietly Permissive
Three reasons:
- No mobile sportsbook market to protect. Without an in-state mobile framework, the AG has no consumer-protection or revenue-loss argument for enforcement against CFTC platforms.
- In-person sports betting competes only with in-person wagering. Mobile event contracts are a structurally different product.
- Conservative federalist tradition. NE defers to federal regulators on novel financial-product questions.
