Are Prediction Markets Legal in Oregon?

Oregon is structurally unique in the US sports-betting market. Unlike every other state with mobile wagering, Oregon does not license multiple commercial operators. Instead, the Oregon Lottery (opens in a new tab) operates a single state-monopoly mobile sportsbook branded as "Scoreboard," powered exclusively by DraftKings under a multi-year contract first signed in 2019 and renewed in 2024. DraftKings is the only mobile sports-betting operator in Oregon. FanDuel, BetMGM, Caesars, ESPN BET, Fanatics Sportsbook — none of them can offer mobile sports betting to OR residents. There is no commercial license to acquire.

This monopoly structure has two profound consequences for Oregon prediction-market trading. First, CFTC-regulated platforms are the only competitive alternative for OR residents who want choice in pricing, market depth, or product range outside the Oregon Lottery's Scoreboard. Second, the standard "DraftKings Predictions / FanDuel Predicts geofenced because parent holds state license" pattern only partially applies in Oregon — DK Predictions is geofenced (DK runs the Lottery's Scoreboard), but FanDuel Predicts and Fanatics Markets are both available in Oregon because their parent companies were locked out of the OR sportsbook market in the first place and have no in-state license to protect.

Why Oregon's Monopoly Structure Makes Prediction Markets Strategically Important

Three reasons:

1. DraftKings has no incentive to compete with itself. DK runs the Oregon Lottery's Scoreboard product as its only OR sportsbook offering. Scoreboard prices, market depth, and product range are constrained by the Lottery's regulatory framework. CFTC prediction markets compete with Scoreboard on every dimension — pricing, market range (politics, macro, crypto, weather all unavailable on Scoreboard), and operator choice.
2. No multi-operator competition pressure on Scoreboard. In states with 5+ commercial sportsbooks, operators compete fiercely on promos, market range and pricing. Scoreboard has no such pressure. Oregon bettors looking for tight spreads, alternative-line markets, or non-sports event contracts have no Scoreboard solution. CFTC platforms fill every one of those gaps.

What Oregon Residents Can Trade Right Now
