Sports betting in ND is restricted to in-person wagering at tribal casinos operated under Indian Gaming Regulatory Act (IGRA) (opens in a new tab) Class III compacts with five federally recognized tribes — the Spirit Lake Tribe, Standing Rock Sioux, Three Affiliated Tribes (MHA Nation), Turtle Mountain Band of Chippewa, and Sisseton-Wahpeton Oyate. Multiple commercial mobile sports-betting bills have been introduced in the ND Legislative Assembly, including HCR 3002 (opens in a new tab) in the 2023 session — none have passed.
For ND residents this means CFTC-regulated prediction markets are the primary legal way to wager on sports outcomes from a phone. The North Dakota AG has not moved against these platforms, and ND tribes have not joined any prediction-market litigation. As a result, every major CFTC-regulated platform is available statewide, including DraftKings Predictions, FanDuel Predicts and Fanatics Markets (which voluntarily geofence most other states).
Why North Dakota Is Quietly Permissive
Three reasons:
- No commercial mobile sportsbook market to protect. Without an in-state regulated mobile framework, the AG has no consumer-protection or revenue-loss argument for enforcement against CFTC platforms.
- Tribal gaming is in-person only. ND tribal casinos compete with in-person wagering, not mobile event contracts. The product overlap is limited, reducing tribal motivation to challenge prediction markets.
- Conservative federalist tradition. ND has historically deferred to federal regulators on novel financial-product questions. CFTC oversight is treated as definitive.
