Prediction Market Status by State: Where Can You Trade in Every State and D.C.?

One status word per platform for every state and D.C., the three states where a court order blocks Kalshi sports contracts, the rows we are watching and the court dates that could change the map.

The short answer

Prediction market access depends on your state and on the platform. All five exchanges we track carry the status Available in 22 states and D.C. Most other states are marked Available — dispute pending. Kalshi's sports contracts are blocked by court order in Nevada, Michigan and Washington, and Nevada is the most restricted state overall.

Where things stand

  • All five Available: 22 states and D.C.
  • Kalshi sports contracts blocked by court order: three states, Nevada, Michigan and Washington. Massachusetts is not one of them: the order there has been paused since February 17, 2026.
  • Being watched: Connecticut sent cease-and-desist orders over sports contracts to nine companies, including Polymarket, Crypto.com (OG), ProphetX and Novig, on September 10, 2026. Ohio's regulator gave Polymarket, ProphetX, Novig and seven other companies until October 16, 2026 to stop sports contracts, so the Ohio row may change.
  • Supreme Court: three petitions are pending and none has been granted. Responses are due November 9 (No. 26-299), November 13 (No. 26-338) and November 16, 2026 (No. 26-344).
  • CFTC: on October 9, 2026 the agency issued an interim final rule and a proposed rule on what counts as a "swap". Neither had been published in the Federal Register when we checked, so neither is in effect.

This page gives every state and D.C. one status word for each of five exchanges: Kalshi, Polymarket US, ProphetX, OG and Novig. A status word says whether a platform takes customers in a state. It does not say whether trading there is lawful, and this page does not give legal advice. Our scoring and checking method explains how we collect the data.

What do the status words mean?

  • Available: the operator accepts residents, we found no state enforcement action or state lawsuit over prediction markets, and the state is not in the Third, Sixth or Ninth Circuit.
  • Available — dispute pending: the operator accepts residents, but the state has an open enforcement action or lawsuit, or it sits in the Third, Sixth or Ninth Circuit, whose sports-contract rulings are under appeal or before the Supreme Court.
  • Sports contracts blocked by court order: a court order in force requires the operator to stop sports contracts in the state. Some other markets may stay open.
  • Not offered: the operator does not accept residents there. The welcome offer is not valid there either.
  • Sports contracts not offered: used for OG only. OG says residents there cannot trade sports contracts but may trade other categories, such as economics or politics.

Platforms check where you are physically located when you trade. "Available" does not mean every market is open. OG is the clearest case: its help center says it is available in all U.S. states, with certain event contracts unavailable in certain states, and its prediction-markets explainer says residents of Nevada, Ohio, Michigan, Maryland, Massachusetts, New Jersey and Illinois cannot trade sports contracts.

What is the status in each state?

Status as of October 3, 2026, with the changes and open cases below re-checked on October 13, 2026. New York's status is Available — dispute pending (as of October 13, 2026). The Circuit column is the federal appeals circuit the state sits in.

* Ohio: the state regulator's October 16, 2026 deadline applies to this platform. We re-check the cell after that date.
† Connecticut: the Department of Consumer Protection sent this platform (OG as Crypto.com) a cease-and-desist order over sports event contracts on September 10, 2026.

How many states does each platform cover?

These are counts of the status words in the table above, D.C. included (51 rows). They are not counts of welcome-offer states.

Where are Kalshi's sports contracts blocked by court order?

  • Nevada: a state court entered a preliminary injunction covering sports, election and entertainment contracts on May 18, 2026, and an agreement with regulators (filed July 23, announced July 24, 2026) required full geofencing by August 12, 2026.
  • Michigan: an Ingham County judge signed a preliminary injunction on September 1, 2026.
  • Washington: a King County Superior Court order covers sports, elections, politics, entertainment, culture, tech and science, and "mentions" contracts. Kalshi had to geofence the state from August 19, 2026, with a stricter system by September 2, 2026.

Some other Kalshi markets stay open in these states. Massachusetts is not on this list. A Superior Court judge ordered Kalshi to stop sports contracts there, but an appeals judge paused that order on February 17, 2026. The state's highest court heard the appeal on May 4, 2026 and had not ruled when we checked on October 13, 2026, so Kalshi's status in Massachusetts is Available — dispute pending.

Which rows are we watching?

  • Connecticut: the Department of Consumer Protection sent cease-and-desist orders on September 10, 2026 to nine companies over sports event contracts: Polymarket, Coinbase, Crypto.com, Robinhood, ProphetX, Novig, Webull, Gemini and Underdog Predict. Kalshi was not on that list; the state sued it separately. We found no official statement on which companies have complied, so the cells stay at Available — dispute pending, with a note.
  • Ohio: the Ohio Casino Control Commission sent cease-and-desist notices dated October 2, 2026 to ten companies, including Polymarket, ProphetX and Novig, with an October 16, 2026 deadline. Kalshi was not a recipient. We found no report that any of them has stopped, so the cells stay as they were, with a note.
  • Missouri: the attorney general wrote to six operators on September 16 and 17, 2026, among them Kalshi, Polymarket US, Crypto.com (OG) and Novig, and gave them 30 days. That deadline falls in mid-October. No lawsuit or court order was found.

Why do so many states say "dispute pending"?

Federal appeals courts are split on sports event contracts, all at the preliminary-injunction stage. The Third Circuit sided with Kalshi on April 6, 2026. The Ninth Circuit (August 28, 2026) and the Sixth Circuit (September 25, 2026) sided with the states. Three Supreme Court petitions, Nos. 26-299, 26-338 and 26-344, are pending and none has been granted.

States in the Third Circuit (New Jersey, Pennsylvania, Delaware), the Sixth (Kentucky, Michigan, Ohio, Tennessee) and the Ninth (Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, Washington) are marked for that reason. Six of them, Alaska, Delaware, Hawaii, Idaho, Oregon and Pennsylvania, have no case of their own in our records. Other states are marked because of their own disputes: New York sued Kalshi in July 2026 and Polymarket US on September 24, 2026, Maryland's appeal is waiting on the Fourth Circuit, and Ohio, Missouri and Connecticut have sent operators letters or orders.

The federal regulator moved too. On October 9, 2026 the CFTC issued an interim final rule saying that sportsbook wagers and casino games are not "swaps", and proposed a rule that would define event contracts on sports, politics, culture and weather as swaps. The interim rule takes effect when it is published in the Federal Register, which had not happened by October 13, 2026. The proposal is not final. Neither changes any cell in the table today.

Is a welcome offer's state list the same as the status?

No. An offer's state count says where a bonus can be claimed. It says nothing about legality, and it can differ from the table above. With code RANKPREDICTS: Kalshi's Trade $25 and Get $25! is valid in 47 states + D.C., Polymarket US's Deposit $10 get a $25 Trading Bonus! in 49 states + D.C., ProphetX's Trade $50, Earn $75! in 49 states + D.C., OG's Trade $25 Get $25 in Rewards! Kalshi's and Polymarket US's minimum age is 18. ProphetX's is 18, or the local age of majority if higher. Novig's is 21. OG's partner terms state no minimum age, so check its sign-up screen. We recommend 21+. Trade only what you can afford to lose.

Frequently asked questions

In which states are all five exchanges available?

Kalshi, Polymarket US, ProphetX, OG and Novig all carry the status Available in 22 states and D.C.: Alabama, Arkansas, Colorado, Florida, Georgia, Indiana, Kansas, Louisiana, Maine, Mississippi, Nebraska, New Hampshire, North Carolina, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Vermont, Virginia, West Virginia and Wyoming. That is the status as of October 3, 2026, and we found no change when we re-checked open cases on October 13, 2026.

Where are Kalshi's sports contracts blocked?

By court order in three states: Nevada, Michigan and Washington. In Massachusetts a court order against Kalshi was paused on February 17, 2026 while the state's highest court decides the appeal, so Kalshi's status there is Available — dispute pending.

Which state is the most restricted for prediction markets?

Nevada. A court order blocks Kalshi's sports, election and entertainment contracts there, Polymarket US, ProphetX and Novig are not offered, and OG does not offer sports contracts there. The Nevada Gaming Control Board said in July 2026 that it had restricted every unlicensed prediction market known to be operating in the state.

What does "Available — dispute pending" mean?

The platform accepts residents of the state, but the state has an open enforcement action or lawsuit over prediction markets, or it sits in a federal circuit whose sports-contract ruling is under appeal or before the Supreme Court. It describes access, not whether trading is lawful.

Does "offer valid in 47 states" mean Kalshi operates in 47 states?

No. An offer count only says where the welcome bonus can be claimed. Where a platform takes customers and whether a state has a court dispute are separate facts, and the status table on this page tracks those.

When will the Supreme Court decide on the prediction market cases?

No date is set. Three petitions (Nos. 26-299, 26-338 and 26-344) are pending and none has been granted. Responses are due on November 9, 13 and 16, 2026, so the earliest the Court could decide whether to hear a case is December 2026 or January 2027, by our estimate.
